# I sold my Circular device without permission. What happens now?

Selling a Circular device without authorisation is a serious violation of the terms you agreed to upon starting your subscription. As Circular retains ownership of all subscribed devices, unauthorised sale constitutes a breach of our Terms of Use ([Singapore](https://nowcircular.sg/terms-of-use?blk=true), [Australia](https://nowcircular.com.au/terms-of-use?blk=true)) and is treated as theft. Circular reserves the right to take legal action against such unauthorized actions. This can include, but is not limited to, employing external debt collection agencies to recover any owed amounts and lodging police reports to address the theft.

## What are the consequences of selling Circular’s device without consent?

Circular will terminate your subscription immediately upon confirmation of the unauthorised sale. You will be held financially responsible for the consequences of this action, which includes paying both the Early Termination Charge and the Non-Return Fee.

**Example scenario:**

* Subscription starts on 05/01/2024 for 12 months at $100 per month.
* Circular discovers that the device was sold by you without our consent on 01/08/2024. As of that date, Circular had received seven monthly payments.
* Circular cancels your subscription and charges you a Non-Return Fee.
* Additionally, an Early Termination Charge of $500 for the remaining 5 months.

 \n Assuming device RRP is $2000:

* Non-Return Fee is calculated as $2000 - 50% of ($700 + $500) = **$1400.**
* **Total due for selling Circular’s device without our consent is $1400 + $500 = $1900.**

If you find yourself unable or unwilling to settle the full amount owed to Circular, despite multiple attempts made in good faith to resolve the payment issue, the entire outstanding debt will be transferred to an external debt collection agency. This agency, acting on behalf of Circular, will employ its agents to collect the owed amount. Should the efforts of the debt collection agency fail to recover the debt, Circular reserves the right to escalate the matter further by lodging a police report against you.
